LEGAL NOTICE 

 

Notice is hereby given that the Board of County Commissioners of Marion County, Ohio, will be offering for sale the following described real estate, 4.612 acres of land known as the Beidler Center:

 

Being part of the Southeast Quarter of Section 18, Township 5 South, Range 16 East, and being the same 4.612 acre tract of land, now or formerly owned by Marion County Commissioners, O.R. 245, page 765, Claridon Township, Marion County, State of Ohio and being more particularly described as follows:

 

Commencing at an existing railroad spike located at the intersection of the East Line of Section 18 with the centerline of State Route 309 (Harding Highway East);

 

Thence along the centerline of State Route 309 South 58 degrees 51 minutes 00 sec.  West for a distance of 828.80 feet to a railroad spike found at Grantor’s Southeast corner and the Southeast corner of hereinafter described 4.612 acre tract and the point of beginning.

 

Thence continuing along the centerline of State Route 309 South 58 deg. 51 min. 00 sec. West for a distance of 472.13 feet to a railroad spike set;

 

Thence North 03 deg. 09 min. 00 sec. West for distance of 644.49 feet to an iron pin set (passing over an iron pin set at a distance of 33.98 feet);

 

Thence North 86 deg. 51 min. 00 sec. East for a distance of 331.49 feet to a 5/8 inch dia. Iron pin found;

 

Thence South 09 deg. 56 min. 40 sec. East for a distance 202.40 feet to a 5/8 inch dia. iron pin found;

 

Thence South 18 deg. 37 min. 40 sec. East for a distance of 230.21 feet to a railroad spike found on the centerline of State Route 309 (passing over a 3/4 inch dia. iron pipe found at a distance of 198.87 feet) and the place of beginning.

 

Containing 4.612 acres, more or less, and subject to legal highways, easements, restrictions and agreements of record. This description prepared from a survey performed by Steven A. Fox, Registered Professional Surveyor 7000, and dated June 9, 1994. All 5/8 inch dia. iron pins set have a plastic identity cap with the inscription “Fox P.S. 7000.”

 Subject to the following easement: 

A permanent Easement for the use of R. B. Windom, Earl W. Seckel and Marjorie F. Gulliford, their successors and assigns, is hereby reserved for access to a field lying directly North of the Case Power and Equipment Lot heretofore described, and is further described as follows:

 

Commencing at an iron pipe at the Northeast corner of said Case Power and Equipment Lot; thence south 06 degrees 47 minutes 40 seconds East, a distance of 202.40 feet to an iron pipe; thence south 15 degrees 28 minutes 40 seconds East, a distance of 30.00 feet to a point; thence North 28 degrees 36 minutes 42 seconds West, a distance of 30.81 feet to a point; thence North 13 degrees 05 minutes 56 seconds West, a distance of 208.26 feet to a point on the North line of said Case Power and Equipment Company Lot; thence North 90 degrees 00 minutes 00 seconds East, along the said North line, a distance of 30.00 feet to an iron pipe, and also the place of beginning.

 

Said described Easement contains 0.09 acres of land, more or less.

Grantors grant to the Grantee a permanent Easement as follows:

 

A permanent Easement is hereby granted for the use of the Case Power and Equipment Company for the use of sewage and waterlines over and through a tract of land described as follows: through the lands of now owned land of R. B. Windom, Earl W. Seckel and Marjorie F. Gulliford, and more particularly described as follows:

 

Commencing at the Northeast corner of the Case Power and Equipment Company Lot; thence South 06 degrees 47 minutes 40 seconds East, a distance of 85.0 feet +-, (More or less) to a point; thence North 72 degrees 00 minutes 00 seconds East, along the centerline of a 20.00 foot Easement (10.00 feet on each side of the centerline), a distance of 340.00 feet, +-, (more or less), to an 8” sewer line of Marion City Sewer System.

 

The same containing 0.16 acres of land, more or less.

The Commissioners will accept sealed written bids for the above described real estate at the County Commissioners office at 222 West Center Street, Marion, Ohio 43302, until the 12th day of March, 2019, at 10:00 A.M.

 

This sale shall be advertised, beginning at least 30 days prior to the date set for the opening of bids, by two publications in a newspaper of general circulation in Marion County, Ohio, and by posting on the Marion County website, co.marion.oh.us and on the State of Ohio website, www.publicnotice.ohio.gov, as provided in R.C. 307.10 and 7.16, as well as on the website of the Marion Star, www.marionstar.com.

 

Sealed written bids must be accompanied by a certified or cashier’s check in the sum of $5,000.00, payable to the Marion County Commissioners.  If the Commissioners accept one of the bids submitted, the checks deposited by the unsuccessful bidders will be returned to them.  If the successful bidder completes the sale, the successful bidder’s deposit shall be applied to the purchase price.  If the successful bidder fails to complete the sale, the $5,000.00 shall be retained by the Marion County Commissioners as liquidated damages for the bidder’s failure.

 

On the 12th day of March, 2019, at 10:00 A.M. the bids will be opened by the Commissioners.  After the opening of the bids, any person or entity who has made a sealed bid may increase the amount of that bid at the time of the bid opening.

 

The Commissioners reserve the right to accept or refuse any and all bids on the property.

 

The property is believed to have access to Marion City sewer and water service, but no warranty is offered by the Commissioners on that matter.

 

The balance of the purchase price must be paid within 30 days after the acceptance of the successful bid.

 

This offer is further made subject to the terms of County Commissioners’ Resolution #2019-0063, adopted January 29, 2019.  A copy of the resolution may be inspected at the offices of the Marion County Commissioners.
